Code of Federal Regulations§ 386.58Burden of proof. (a) Enforcement cases. The burden of proof shall be on the Administration in enforcement cases. (b) Conflict of medical opinion. The burden of proof in cases arising under §391.47 of this chapter shall be on the party petitioning for review under §386.13(a).
